Concierge Care and Chat Program

University of Maryland Quality Care Network provides population health management, pharmacy and case management services to the group health plan sponsored by the University of Maryland Medical System Corporation (“Group Health Plan”). To facilitate the provision of these services, this GoMo Health Concierge Care® software platform provides Group Health Plan members with access to educational information and other clinical resources based on a member’s responses to a voluntary health risk assessment (the “UMMS Concierge Care and Chat Program”, also known as “StayWell”).  By agreeing to these terms and conditions, you consent and authorize the University of Maryland Medical System Corporation (“UMMS”), the University of Maryland Quality Care Network, and their agents to:

Participation in the UMMS Concierge Care and Chat Program is voluntary. It is not designed to replace care from a medical professional and does not provide medical advice, professional diagnosis, opinion, treatment, or services. 

Information provided by the UMMS Concierge Care and Chat Program is for informational and educational purposes only. After reading care messages or web pages, you are encouraged to review the information carefully with a medical professional. 

Never disregard professional medical advice, delay seeking care and treatment, or rely on the information contained in this UMMS Concierge Care and Chat Program in place of seeking professional medical advice. The information sent through text or learned through engagement with or participation in any UMMS Concierge Care and Chat Program, activities or services should not be considered as a medical consultation, nor is it meant to replace a provider’s work-up, recommendations, assessment of the appropriateness or risks of any care or treatment delivered to a participant, or decisions made in the care or treatment of a participant.

NOTICE AND AUTHORIZATION REGARDING WELLNESS PROGRAM

The UMMS Concierge Care and Chat Program (also referred to as StayWell) is a voluntary wellness program available to all participants in the group health plan sponsored by the University of Maryland Medical System Corporation (UMMS). The program is administered according to federal rules permitting employer-sponsored wellness programs that seek to improve employee health or prevent disease, including the Americans with Disabilities Act of 1990, the Genetic Information Nondiscrimination Act of 2008, and the Health Insurance Portability and Accountability Act, as applicable, among others. If you choose to participate in the UMMS Concierge Care and Chat Program you will be asked to complete a voluntary health risk assessment or “HRA” that asks a series of questions about your health-related activities and behaviors and whether you have or had certain medical conditions (for example, diabetes, heart disease, or high cholesterol). You are not required to complete the HRA.   

However, only plan members who choose to complete the HRA will have access to the educational information and other clinical resources available through the UMMS Concierge Care and Chat Program.  

The information from your HRA will be used to provide you with feedback and educational information to help you understand your current health and potential risks, and may also be used to offer you wellness program services, such as pharmacy, maternity, chronic condition care management and vital social determinants like housing, nutrition, and access to supportive networks crucial for fostering good health. You also are encouraged to share your results or concerns with your medical provider.

Protections from Disclosure of Medical Information

University of Maryland Quality Care Network (the administrator of the UMMS Concierge Care and Chat Program) and GoMo Health (the provider of the software platform for the UMMS Concierge Care and Chat Program) are required by law to maintain the privacy and security of your personally identifiable health information. Although aggregate information collected by the UMMS Concierge Care and Chat Program may be used to design a program based on identified health risks in the workplace, it will never disclose your personal information either publicly or to your employer, except as necessary to respond to a request from you for a reasonable accommodation needed to participate in the wellness program, or as expressly permitted by law. Medical information that personally identifies you that is provided in connection with the wellness program will not be provided to your supervisors or managers and may never be used to make decisions regarding your employment.  

Your health information will not be sold, exchanged, transferred, or otherwise disclosed except to the extent permitted by law to carry out specific activities related to the wellness program, and you will not be asked or required to waive the confidentiality of your health information as a condition of participating in the wellness program or receiving an incentive. Anyone who receives your information for purposes of providing you services as part of the wellness program will abide by these same confidentiality requirements. The only individual(s) who will receive your personally identifiable health information are Nurse Case Managers, Pharmacists, Social Workers, Health Coaches and other staff where necessary to provide you with services under the wellness program.  

In addition, all medical information obtained through the wellness program will be maintained separate from your personnel records and information stored electronically will be encrypted. No information you provide as part of the wellness program will be used in making employment decisions. Appropriate precautions will also be taken to help prevent data breaches, and in the event a data breach occurs involving information you provide in connection with the wellness program, we will notify you where required by law.  

You may not be discriminated against in employment because of the medical information you provide as part of participating in the wellness program, nor may you be subjected to retaliation if you choose not to participate.

HIPAA Disclosure

By agreeing to these terms and conditions, you acknowledge  that text is not considered to be a secure technology. GoMo Health will not send protected health information via text as part of this UMMS Concierge Care and Chat Program.

General Privacy Policy 

GoMo Health respect your privacy. GoMo Health Concierge Care® is a software platform with educational content that is available via a web link in a text message. GoMo Health does not sell, trade, or rent your personal information to other companies or individuals. GoMo Health uses industry-leading Secure Sockets Layer (SSL) technology to keep your personal information as secure as possible. Participant information will only be used for its intended purpose. 

By your participation, you give GoMo Health permission to provide your information to University of Maryland Quality Care Network to be used for the provision of population health management, pharmacy and case management services. 

Any personal identifying information collected is stored in our secure cloud-based database, and GoMo Health will disclose this information only as permitted by applicable state and federal laws. 

At the current time and this point of development, the UMMS Concierge Care and Chat Program is intended for use by residents of the United States.

Additionally, the UMMS Concierge Care and Chat Program websites are hosted in the United States of America and are subject to U.S. state and federal law. If you are accessing the UMMS Concierge Care and Chat Program from locations from outside of the United States, please be advised that you are transferring your personal information to us in the United States, and by using the UMMS Concierge Care and Chat Program, you consent to that transfer and use of your personal information in accordance with this Privacy Policy. 

You also agree to abide by the applicable laws of applicable states and U.S. federal law concerning your use of the Website and your agreements with us. Any persons accessing the UMMS Concierge Care and Chat Program websites from any jurisdiction with laws or regulations governing the use of the Internet, including personal data collection, use and disclosure different from those of the jurisdictions mentioned above may only use the Websites in a manner lawful in their jurisdiction. If your use of the UMMS Concierge Care and Chat Program website would be unlawful in your jurisdiction, please do not use the Website. 

BY USING OR ACCESSING THE WEBSITE, YOU ARE ACCEPTING THE PRACTICES DESCRIBED IN THIS PRIVACY POLICY.

Children

The Children’s Online Privacy Protection Act (“COPPA”) protects the online privacy of children under 13 years of age. We do not knowingly collect or maintain personal information from anyone under the age of 13, unless or except as permitted by law. Any person who provides personal information through this program represents to us that he or she is 13 years of age or older. If we learn that personal information has been collected from a user under 13 years of age, then we will take the appropriate steps to cause this information to be deleted. If you are the parent or legal guardian of a child under 13 who has joined this program or has otherwise transferred personal information, please contact GoMo Health using our contact information below to have that child’s account terminated and information deleted.

Personal Information

GoMo Health aggregates and de-identifies the participant information voluntarily submitted from this UMMS Concierge Care and Chat Program to improve the program performance. GoMo Health may also receive Personal Health Information about participant health from the University of Maryland Quality Care Network. GoMo Health may also aggregate the information from the UMMS Concierge Care and Chat Program and the University of Maryland Quality Care Network solely for purposes of improving the performance of the UMMS Concierge Care and Chat Program and providing services to the Group Health Plan pursuant to the terms of its agreement with UMMS.

Text and E-mail

When a participant sends a text message and/with program-specific data, their mobile phone number and/or e-mail address, the full content of the message, attached files, or other information provided may be recorded. The UMMS Concierge Care and Chat Program may use this information to determine and send appropriate information or educational content to participants. GoMo Health may not use this information for purposes other than the provision of services to the Group Health Plan pursuant to the terms of its agreement with UMMS. Participants may indicate their preference to stop receiving communications or opt-out at any time. (See Your Choices Regarding Your Personal Information).

Security 

The UMMS Concierge Care and Chat Program encrypts sensitive information such as your personal information using secure socket layer (SSL) technology to provide the secure transmission of the information from your computer to our servers. For more information about the security measures used in connection with the UMMS Concierge Care and Chat Program, please contact us using the contact information found below.

Information Collected Via Technology

As you use these pages, certain message delivery information may be passively collected and stored on GoMo Health’s or it’s service providers’ server logs, including your internet protocol address, browser type, and operating system. GoMo Health also uses cookies and navigational data like Uniform Resource Locators (‘URLs’) to gather information regarding the date and time of your web page visit and the information viewed. ‘Cookies’ are small pieces of information that a website sends to your computer’s hard drive while you are viewing the site. An internet protocol (or IP) address is a number that is automatically assigned to a participant’s computer when they use the internet. In some cases, an IP address may stay the same from browser session to browser session; but if participants use a consumer internet service provider (ISP), your IP address will likely vary from session to session. The UMMS Concierge Care and Chat Program may use both session cookies (which expire once the web browser closes) and persistent cookies (which remain on the computer until deleted) to provide a more personal and interactive experience. Persistent cookies can be removed by following the internet browser’s help file directions. Participants may manage cookie preferences via browser settings (see http://www.aboutcookies.org for more information)

Use and Disclosure of Information

In general, personal information submitted and/or shared with the UMMS Concierge Care and Chat Program may be used for the following purposes: to enable participant access to UMMS Concierge Care and Chat Program services; to personalize the content received by the UMMS Concierge Care and Chat Program; and/or to provide additional information and functionality upon request. 

Except as otherwise stated in this Privacy Policy, the UMMS Concierge Care and Chat Program does not sell, trade, rent, or otherwise share the personal information that we collect with third parties. GoMo Health may, when required, provide personal information to third-party service providers or affiliates who work on its behalf, to provide some of the services and features necessary to help communicate with participants. Examples of such services include sending texts or e-mails, analyzing data, and providing customer service. Participant information is provided under a Business Associates Agreement (BAA) to the affiliates and third-party service providers and are not to be utilized in any manner except as necessary to provide the relevant UMMS Concierge Care and Chat Program services and in compliance with law. If you are not willing for the UMMS Concierge Care and Chat Program to use or disclose your collected personal information as identified above, you may choose to not participate in the UMMS Concierge Care and Chat Program.

The UMMS Concierge Care and Chat Program uses Google Analytics to analyze how visitors interact with the UMMS Concierge Care and Chat Program website. This service provides us with non-personally identifiable data including but not limited to data on where visitors came from, what actions they took on our site, and where visitors went when they left our site.

The UMMS Concierge Care and Chat Program may also develop non-personal information concerning visitors to GoMo Health web pages, using de-identification processes to help ensure that such information cannot reasonably be re-associated or connected with participants. Generally, this information is de-identified and aggregated to be used in statistical analysis to help analyze patterns of use. This Privacy Policy does not limit use or disclosure of de-identified information (i.e., that is not connected with an individual user) in any way, and GoMo Health reserves the right to use and disclose such information to program partners, sponsors, and other third parties at our discretion. 

In the event GoMo Health goes through a business transition such as a merger, acquisition by another company, or sale of all or a portion of our assets, your personal information may be among the assets transferred. Program participants acknowledge that such transfers may occur and are permitted by this Privacy Policy, and that any acquirer will continue to process protected health information with HIPAA compliance and as set forth in this Privacy Policy. 

The UMMS Concierge Care and Chat Program may disclose personal information if it is believed in good faith that such disclosure is necessary to; (a) comply with relevant laws or to respond to subpoenas or warrants served on us; or (b) to protect and defend our rights, property, or you the participant. You hereby consent to us sharing your personal information under the circumstances described herein.

Privacy Policy Changes 

This Privacy Policy may be changed from time to time. Any and all changes to this Privacy Policy will be reflected on this page and the date new versions are posted will be stated at the top of this Privacy Policy. Unless stated otherwise, this Privacy Policy applies to all information GoMo Health has about you and your account. Users should regularly check this page for any changes to its Privacy Policy.

Your Choices Regarding Your Personal Information

You may at any time review or change your personally identifying information by going to your account settings (if applicable) or contacting us at support@gold-group.com. Participants have a right at any time to opt-out of the UMMS Concierge Care and Chat Program or to discontinue UMMS Concierge Care and Chat  Program contact by replying ‘STOP’ after receiving any of the program text messages. Participants may also contact GoMo Health directly, via email, at support@gold-group.com .  Messages for the purpose of providing or administering health coverage for which you are actively enrolled are not subject to this opt-out provision. Upon your request, GoMo Health will deactivate or delete your account and contact information from its active databases. Such information will be deactivated or deleted as soon as practicable based on your account activity and accordance with our deactivation policy and applicable law. To make this request, either go to your account settings (if applicable) or contact GoMo Health as provided above. GoMo Health will retain in its files some personal information to prevent fraud, to troubleshoot problems, to assist with any investigations, to enforce these Terms and Conditions and to comply with legal requirements as is permitted by law. Therefore, you should not expect that all your personal information will be completely removed from GoMo Health’s databases in response to your requests. Additionally, GoMo Health keeps a history of changed information to facilitate security reviews, and to investigate suspected fraud with your account as needed.
